This website and online store are operated by Momentum Tribe Ltd, trading as Momentum Tribe Shop.

Throughout these Terms of Service, the terms ‘we’, ‘us’ and ‘our’ refer to Momentum Tribe Ltd.

These Terms of Service explain the terms that apply when you access our website, use our online store or purchase products from us.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you. We also work with specialist third-party production, fulfilment and delivery providers.

Please read these Terms carefully before using our website or placing an order.

By using our website or purchasing from us, you agree to these Terms of Service together with our:

Nothing in these Terms affects your statutory rights under UK consumer law.

You may use our website only for lawful purposes.

You must not:

• Use the website in a way that breaks any applicable law or regulation
• Attempt to gain unauthorised access to the website, its systems or customer information
• Introduce viruses, malicious code or other harmful technology
• Interfere with the website’s security or operation
• Copy, reproduce or commercially exploit our website content without permission
• Submit false, misleading, abusive, defamatory or unlawful material
• Impersonate another person or provide false information

We may suspend or restrict access to the website where we reasonably believe it is being misused.

  1. ACCOUNT AND CUSTOMER INFORMATION

You may be asked to provide information when creating an account, placing an order or contacting us.

You agree that the information you provide will be accurate, current and complete.

You are responsible for:

• Checking your order information before submitting it
• Providing a complete and accurate delivery address
• Keeping any account login information secure
• Informing us promptly if you believe your account has been accessed without permission

We are not responsible for delays or additional costs caused by inaccurate information supplied by you, although this does not affect any rights you may have where we are at fault.

  1. OUR PRODUCTS

Our products are generally produced after an order is placed using a specialist print-on-demand production and fulfilment partner.

We make reasonable efforts to ensure that product descriptions, photographs, sizing information, colours and other details are accurate.

However:

• Colours may appear slightly different depending on your screen and device settings
• Product dimensions may be subject to reasonable manufacturing tolerances
• The position, scale or appearance of a printed design may vary slightly between products
• Product packaging may vary depending on the production or fulfilment provider
• Minor variations that do not affect the product’s overall quality or use may not amount to a fault

Nothing in this section limits your rights if a product is faulty, damaged, not as described or not fit for purpose.

We may change or discontinue products without notice. Changes will not affect orders we have already accepted unless we contact you and agree an appropriate alternative or refund.

  1. SIZING AND PRODUCT SELECTION

Please check the product description, measurements, sizing guide, colour and other selected options carefully before placing your order.

Products are made after your order is submitted, so we may be unable to change a size, colour, design or other product selection once production has begun.

This does not affect any statutory cancellation rights that apply to eligible, non-personalised products after delivery.

  1. PLACING AN ORDER

When you place an order, you are offering to purchase the products in your basket under these Terms.

You will normally receive an automated order acknowledgement or confirmation through Shopify.

An order is accepted when we confirm it has been accepted or begin processing it for production, whichever happens first.

We may refuse or cancel an order where, for example:

• The product is unavailable
• There is an obvious pricing or description error
• We cannot authorise or process your payment
• We cannot deliver to the address provided
• We reasonably suspect fraud or unauthorised activity
• The order breaches these Terms or another store policy

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

  1. CORRECTING ORDER ERRORS

You will have an opportunity to review your basket, delivery details and order total before completing your purchase.

Please contact us immediately at themomentumtribe@gmail.com if you notice an error after placing an order.

We will try to help, but because products may enter production shortly after an order is placed, we cannot guarantee that changes or cancellations can be made before dispatch.

  1. PRICES AND PAYMENT

Unless stated otherwise, all prices shown on our UK store are in pounds sterling.

Momentum Tribe Ltd is not currently registered for VAT, so VAT is not separately charged or shown on orders.

The price payable will be the price displayed at checkout when you place your order, together with any applicable delivery charges.

Delivery charges will be shown before you complete payment.

We may change prices at any time, but price changes will not affect orders already accepted.

Payment is processed through the payment methods made available at checkout. Payment services may be provided by Shopify or another authorised payment provider.

You confirm that:

• You are authorised to use the payment method provided
• The payment and billing information supplied is accurate
• Sufficient funds or credit are available to complete the purchase

  1. PROMOTIONS AND DISCOUNT CODES

From time to time, we may offer discount codes or promotions.

Unless stated otherwise:

• Promotions cannot be exchanged for cash
• Only one discount code may be used per order
• A discount code must be entered before the order is completed
• Promotions may be subject to specific products, dates, minimum spends or availability
• We may withdraw or correct a promotion where it has been published in error

Separate promotional terms will take priority where they conflict with this section.

  1. PRODUCTION AND FULFILMENT

Our products are produced and fulfilled by third-party print-on-demand providers.

When you place an order, the necessary product, customer and delivery information may be shared with Shopify, our production partner, payment providers and delivery companies so that your order can be processed and delivered.

Products within the same order may occasionally be produced by different providers or dispatched separately. This means they may arrive in more than one parcel or on different dates.

  1. DELIVERY

Delivery times shown on our website or in order communications are estimates unless we expressly agree a guaranteed delivery date with you.

We will take reasonable steps to deliver your order within the stated timeframe and will contact you if we become aware of a significant delay.

We are responsible for the products until they are delivered to:

• You
• A person identified by you to receive them
• A safe place or collection location authorised by you, where applicable

We do not transfer responsibility for the products to you merely because they have been handed to a courier.

Delivery may be affected by circumstances outside our reasonable control, including carrier disruption, severe weather, customs processing, strikes, transport disruption or other exceptional events.

If there is a substantial delay, we will handle the matter in accordance with applicable consumer law and our Shipping Policy.

  1. DELIVERY ADDRESSES

You are responsible for providing a complete and accurate delivery address.

Please contact us immediately if you realise that the address is incorrect.

We cannot guarantee that an address can be changed after production or fulfilment has begun.

Where an order cannot be delivered because an incomplete or incorrect address was supplied, additional production or delivery charges may apply before it can be sent again.

This does not apply where the delivery problem was caused by us, our production partner or the delivery provider.

  1. CUSTOMS AND IMPORT CHARGES

Where international delivery is available, an order may be produced or dispatched from a country different from the customer’s delivery country.

International orders may be subject to customs duties, import taxes, handling charges or other local fees.

Where these charges are not collected at checkout, the customer may be responsible for paying them to the relevant authority or delivery provider.

Any known delivery restrictions or charges controlled by us will be displayed during checkout or explained in our Shipping Policy.

  1. ORDER COMMUNICATIONS

Shopify will normally send communications such as:

• Order confirmations
• Payment confirmations
• Dispatch notifications
• Tracking information
• Delivery updates

After delivery, customers may also receive an unbranded email from customer@trackorder.site on behalf of Momentum Tribe Shop through our post-delivery support service.

Customers should use the link contained in that email to report an eligible damaged, faulty, misprinted or incorrect product.

The email address customer@trackorder.site should not be contacted directly.

  1. DAMAGED, FAULTY, MISPRINTED OR INCORRECT PRODUCTS

Please inspect your products after delivery.

If a product is damaged, faulty, misprinted or different from the product ordered, you should report the issue as soon as reasonably possible.

You may use the post-delivery support link sent after delivery or contact us at themomentumtribe@gmail.com.

You may be asked to provide:

• Your order details
• A description of the issue
• Clear photographs of the product and the problem
• Photographs of the packaging or shipping label, where relevant

Depending on the circumstances and your legal rights, an appropriate resolution may include a reprint, replacement, repair, price reduction or refund.

Our production partner’s internal eligibility rules do not restrict or replace your statutory rights against Momentum Tribe Ltd.

  1. CANCELLATIONS, RETURNS AND REFUNDS

Your rights to cancel an eligible online order, return products or request a refund are explained in our Returns and Refunds Policy.

UK customers purchasing eligible, non-personalised products online will generally have a statutory cancellation period.

Products personalised or made to a customer’s individual specifications may be excluded from change-of-mind cancellation rights. This exclusion does not apply where the product is faulty, damaged, not as described or otherwise does not meet legal requirements.

Nothing in these Terms removes or limits your statutory consumer rights.

  1. PERSONALISED PRODUCTS

Some products may allow customers to request names, wording, photographs, dates or other individual customisation.

You are responsible for checking that any personalised information submitted is accurate and that you have permission to use any names, photographs, wording, logos or other material provided.

We may refuse personalised content that:

• Infringes another person’s intellectual property rights
• Is unlawful, defamatory, threatening or abusive
• Contains discriminatory, hateful or obscene material
• Could reasonably cause harm
• Breaches the requirements of our production provider

We are not responsible for spelling or other errors contained in personalised information submitted and approved by the customer, unless the finished product differs from the information provided.

  1. INTELLECTUAL PROPERTY

The website and its content, including our designs, branding, logos, text, graphics, photographs and product artwork, are owned by or licensed to Momentum Tribe Ltd unless stated otherwise.

Content is protected by applicable copyright, trade mark and other intellectual property laws.

You may access and use the website for personal, non-commercial shopping purposes.

You must not, without our prior written permission:

• Copy or reproduce our designs or product artwork
• Manufacture or sell products using our designs
• Republish substantial parts of our website
• Use our branding in a way that suggests an association or endorsement
• Remove copyright, trade mark or ownership notices
• Use our content for commercial training datasets, product generation or resale

Shopify’s name, logos and technology remain the property of Shopify or its licensors.

  1. REVIEWS, FEEDBACK AND CUSTOMER CONTENT

You may be able to submit reviews, photographs, comments or other feedback.

You confirm that:

• The content is truthful and reflects your genuine experience
• You own the content or have permission to submit it
• It does not infringe another person’s rights
• It is not unlawful, abusive, defamatory, threatening, obscene or misleading
• Any incentive received for providing the content has been disclosed where required

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use submitted reviews and feedback for operating and promoting Momentum Tribe Shop.

This licence does not transfer ownership of your content to us.

We may moderate or remove content that breaches these Terms, applicable law or the rights of another person.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may contain services, features or links provided by third parties, including Shopify, payment providers, social media platforms and delivery tracking services.

Third-party websites and services are governed by their own terms and privacy policies.

We are not responsible for unrelated third-party websites or content that we do not own or control.

This does not exclude responsibility where a third-party provider is acting on our behalf to fulfil our obligations to you.

  1. SHOPIFY’S ROLE

Momentum Tribe Shop is powered by Shopify, which provides the ecommerce platform used to operate our store.

Any purchase you make from Momentum Tribe Shop is made directly between you and Momentum Tribe Ltd.

Shopify is not the seller of our products and is not responsible for fulfilling your order, providing the products or dealing with your statutory rights as the customer.

Nothing in this section affects any responsibility Shopify may independently have to you under applicable law or under a separate agreement between you and Shopify.

  1. PRIVACY AND COOKIES

We process personal information in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain information to provide and secure the ecommerce platform.

Information may also be shared with relevant production, payment, support and delivery providers where necessary to process and fulfil an order, handle a customer request, prevent fraud or comply with legal obligations.

Our website may use cookies and similar technologies. Where legally required, you will be given choices about non-essential cookies through our cookie consent settings.

  1. WEBSITE AVAILABILITY

We aim to keep our website available and accurate, but we do not guarantee that access will always be uninterrupted or error-free.

We may temporarily suspend or change the website for maintenance, security, technical, operational or legal reasons.

We will not be responsible for losses caused solely by temporary website unavailability where we have taken reasonable care and the matter was outside our reasonable control.

  1. ERRORS AND INACCURACIES

Occasionally, our website may contain a typographical error, inaccurate description, incorrect price or other mistake.

We may correct errors and update information when identified.

If an error affects an order you have already placed, we will contact you. We will not charge a higher price or supply a materially different product without your agreement.

Where we cannot fulfil the order as agreed, we may cancel the affected product and issue a refund.

  1. OUR RESPONSIBILITY TO YOU

We do not exclude or limit liability where doing so would be unlawful.

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of your statutory consumer rights
• Defective products where liability cannot legally be excluded
• Any other liability that cannot legally be excluded or limited

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Our products are supplied for personal and domestic use. We are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption, arising from use of a product for commercial purposes that we did not agree to supply it for.

  1. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure caused by an event outside our reasonable control.

Such events may include:

• Severe weather or natural disasters
• War, terrorism or civil unrest
• Industrial action
• Transport or postal disruption
• Government restrictions
• Major internet, utility or communications failures
• Disruption affecting our production or delivery providers

We will take reasonable steps to minimise the effect of the event and keep affected customers informed.

Your legal rights relating to delayed or undelivered products will continue to apply.

  1. SUSPENSION OR TERMINATION

We may suspend or terminate a customer account or access to parts of our website where we reasonably believe that:

• These Terms have been materially breached
• Fraudulent or unlawful activity has taken place
• The website or another person is at risk
• Suspension is required by law or a relevant authority

Termination will not affect rights or obligations that arose before termination, including the obligation to pay for orders already supplied.

  1. GOVERNING LAW

These Terms and any contract between you and Momentum Tribe Ltd are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you will continue to benefit from any mandatory protections provided by the law applicable where you live.

You may bring proceedings in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also be entitled to bring proceedings in the courts where you live.

  1. SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, that part will be treated as removed only to the extent necessary.

The remaining provisions will continue to apply.

  1. WAIVER

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

Any waiver will apply only to the specific circumstances in which it is given.

  1. CHANGES TO THESE TERMS

We may update these Terms where necessary to reflect changes to:

• Our products or services
• Our fulfilment arrangements
• Shopify or other service providers
• Applicable law or regulation
• The operation or security of our website

The current version will be published on this page with the date it was last updated.

Changes will not retrospectively reduce rights relating to an order already placed.
